TERMS & CONDITIONS

Please read the following terms and conditions carefully as you should understand and agree with them fully before proceeding with any booking through bluetravel.com.au and/or blueco.com.au. The terms and conditions stated below apply to all bookings regardless of whether they are made through our website(s), over the phone or by email. If you do proceed with the booking it will be assumed that you have agreed to all following terms and conditions.

BOOKING TERMS & CONDITIONS

Prices, Brochures and Website Validity

All prices are quoted in Australian Dollars (A$) and are inclusive of GST. Tour prices are per person, are correct at time of publication and can be subject to change at the discretion of Blue Travel (Blue Travel Pty Ltd). All prices listed on this website are valid for the travel period as stated on the individual tour detail pages.

Inclusions

Pre-packaged tours include all sightseeing, entry fees and meals as stated in the full itinerary, however are subject to change solely at the discretion of Blue Travel (Blue Travel Pty Ltd).

Contract

All bookings are made with Blue Travel Pty Ltd (ABN 40 070 160002) trading as blueco.com.au and bluetravel.com.au.

Condition of Travel

Blue Travel (Blue Travel Pty Ltd) reserves the right to alter the route or itinerary of any of its tours and arrange alternative carriers to those advertised if necessary. No refunds will be given in these circumstances or in the event of any delay, curtailment or alteration of a trip resulting from any cause beyond our control, including but not limited to severe weather conditions. Components of trips are weather dependant and Blue Travel (Blue Travel Pty Ltd) cannot be held liable if trip components are not available on the day of travel. Blue Travel (Blue Travel Pty Ltd) cannot guarantee pick up or drop off times and is not liable for passenger failure to connect with other services or any associated costs resulting from such delays. We accept no responsibility for loss or damage to personal belongings or baggage. The Aboriginal components of our tours are subject to cultural conditions. Participants may be absent due to cultural commitments with minimal prior notification and Blue Travel (Blue Travel Pty Ltd) reserves the right to amend the itinerary in these circumstances with no obligation to refund.

Liability

To the fullest extent permitted by law:
Blue Travel (Blue Travel Pty Ltd) accepts no responsibility or liability for damage, loss, injury or delays whilst travelling with us.
Blue Travel (Blue Travel Pty Ltd) is not responsible for the acts and omissions by its employees, agents, contractors or third parties that customers may encounter whilst travelling with us.
You release Blue Travel (Blue Travel Pty Ltd) and its officers, employees, agents and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip.
Blue Travel (Blue Travel Pty Ltd) also assumes no responsibility for any act of negligence, act or omission whatsoever by any company whose services are used as part of packages provided, including but not limited to activity and accommodation providers.
Any condition or warranty which would otherwise be implied by law into these Booking Conditions (Implied Warranty) is excluded.

Minimum Numbers / Itineraries

Tours require minimum passenger numbers to operate. In circumstances where minimum numbers are not reached, an alternative may be offered or a smaller vehicle used.

Travel Insurance

Travel insurance is not included. Blue Travel (Blue Travel Pty Ltd) recommends that passengers take out their own travel insurance policy which covers personal liability, cancellation, loss of luggage and personal effects.

 

CANCELLATION AND CHANGE POLICY

Cancellation by the customer

Due to the extensive organisation involved with touring, a strict cancellation fee will be applicable to compensate for costs and lost revenue. We strongly recommend you take out travel insurance to cover against such charges. Once a booking is made, cancellation fees will apply as follows:

Cancellation Fees

  • 30+ days prior to departure; no fees payable
  • 16-29 days prior to departure; 20% of total price
  • 15-3 days prior to departure; 50% of total price
  • Less than 3 days to departure; 100% of total price

If you fail to join a tour or join it after departure, or leave it prior to its completion, no tour refund can be made. The above cancellation fees are in addition to fees which may be levied by accommodation properties, travel agents or third party tour and transport operator cancellation fees.

Amendments to Booking

Changes to the date of your trip can be made free of charge when made more than 14 days before the date of the trip, but can only be made once per booking.

Amendments to any other arrangements made in conjunction with your trip may incur an A$100 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 7 days of departure. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.

Cancellation by Blue Travel

Blue Travel reserves the right to cancel the trip at anytime. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or alternatively receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

Deposits and Final Payment

A deposit of 50% is required at the time of making your booking to confirm a tour if said tour is more than 14 days away at the time of booking.
The balance of your booking i.e. full cost less the initial deposit, is due 14 days before the date of your trip.
Failure to adhere to the payment policy may result in cancellation of your booking. You will be denied entry onto the tour and you will forfeit any deposit paid.
Credit card payments may attract a surcharge of 1.5% (Visa and MasterCard Only). Please note all bookings made online and via this website must be paid in full at time of booking confirmation.

 

Departure Points

The departure point of the trip will be advised at the time of booking but Blue Travel reserves the right to change the departure point. If the departure point is changed the customer will be notified before the departure.

 

Alcohol Consumption

Under the Liquor Control Act 1988, it is an offence: to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises.
Blue Travel takes under age drinking very seriously. All passengers must be able to provide identification to prove they are 18 and over before they can consume alcohol whilst on a Bue Travel trip.
No alcohol is to be consumed on any of the Blue Travel vehicles.

 

Photographs

You agree that Blue Travel is able to use images of you captured on the trips for use on our website or in marketing material. If you do not want your image to be used you will need to notify Blue Travel in writing before the start of the trip.

The information set out by us on these pages tells you how you can use these services, tools and functionality to find out about and book our products (as well as those provided by our selected partners), view content provided by us, interact with us and submit and share views with other customers. B. OUR SUPPLY OF PRODUCTS AND SERVICES

Normally when you purchase our products and/or services and book travel arrangements on this Website your agreement is with Blue Travel and if not we will make it clear to you that Blue Travel is acting as an agent for another travel provider. See our Booking Terms and Conditions for the terms and conditions relevant to the purchase of travel products, trips and holidays from us.

In addition, when you book any products or services from us, you will do so subject to these Website Terms and Conditions, our Booking Terms and Conditions and such further terms and conditions as may be applied by the hotel or properties where you will be staying (together, the “Conditions of Contract”). These Conditions of Contract constitute the entire agreement and understanding between you and Blue Travel in relation to their subject matter. By proceeding with a booking, you acknowledge that you have read and understood all of the Conditions of Contract and agree to be bound by them. However, if you do not or cannot accept our Conditions of Contract in full, you must stop using our Website immediately. These Conditions of Contract may vary from time to time. By browsing this Website you accept that you are bound by the Conditions of Contract current at the time when you browse or book.

Please note that Blue Travel may provide accommodation, transport from a wide range of third party accommodation providers and carriers including airlines, ships and railways. The provision of these arrangements will be subject to the terms and conditions of each provider or carrier as part of your Conditions of Contract with us (either as agent for the provider or carrier or as part of our holiday package as you will see in section of the Booking Terms and Conditions). Other holiday and travel related services such as travel insurance, car hire, foreign exchange and travel money cards are supplied by our selected service providers and are available for you to purchase through our own branded websites or directly via the supplier website – the supply of these products and services to you shall be subject to the terms and conditions of each service provider and not us. We cannot list all of the supplier’s and their terms and conditions here but you will be able to find the terms and conditions or conditions of carriage for these suppliers on their own web sites – you will need to have read them carefully before you book and/or travel.

We will store and use the information you supply us or which is supplied to us in your use of this Website (“your information”) for the purposes set out in our Privacy Policy section.
